Terms of Service of ModelAgora.com

effective as of 06.08.2025

1. General Information

1.1. The owner and operator of the online platform ModelAgora.com is:

1.2. The ModelAgora.com service (hereinafter: Platform) is an online intermediary platform that allows Users (hereinafter referred to as Sellers) to post offers for the sale of models, accessories, and other modeling products, and other Users (hereinafter referred to as Buyers) to purchase them.

1.3. DEVENUE Sp. z o.o. is not a party to sales agreements concluded between Buyers and Sellers (except in cases where it acts as a Seller itself) and is not responsible for the performance of such agreements.

2. Definitions

  • User – any natural or legal person with an account on the ModelAgora.com website.
  • Seller – a User offering products through the Platform.
  • Buyer – a User purchasing products through the Platform.
  • Product – an item listed for sale on the Platform.
  • Terms of Service – this document outlining the rules for using the Platform.

3. Registration and User Account

3.1. Registration on the Platform is voluntary and free of charge.

3.2. By registering, the User accepts these Terms of Service and agrees to comply with them.

3.3. The User agrees to provide truthful information and update it in case of any changes.

3.4. The account may be deleted by the User at any time or by the Administrator in case of violation of the Terms of Service.

4. Role of ModelAgora.com as an Intermediary Platform

4.1. ModelAgora.com provides the technical means to present and sell products but is not a party to transactions concluded between Sellers and Buyers.

4.2. Each Seller is responsible for:

  • the accuracy and completeness of the Product description,
  • the availability of the Product,
  • order fulfillment (including shipping),
  • after-sales service, including warranties and complaints,
  • issuing appropriate sales documents.

4.3. The Buyer acknowledges that any claims regarding the purchased Product (e.g., returns, complaints, delays) should be addressed directly to the Seller.

5. Rules for Posting Offers and Selling

5.1. The Seller may post product offers in line with the website’s theme (modeling, dioramas, figurines, etc.).

5.2. It is prohibited to list:

  • products that are illegal under applicable law,
  • counterfeit and non-original goods,
  • content that infringes copyrights or personal rights.

5.3. The Seller is obliged to comply with consumer sales regulations, including the right to withdraw from the contract (14 days) and complaint handling.

5.4. The Seller may be removed from the Platform in case of violation of the Terms of Service or applicable law.

6. Payments and Deliveries

6.1. ModelAgora.com does not process payments on behalf of Sellers – all transactions take place directly between the Buyer and the Seller.

6.2. Each Seller independently determines the available payment methods and delivery options.

6.3. The Platform is not responsible for delays, lost shipments, or incorrect settlements between transaction parties.

7. Reviews and Ratings

7.1. The Buyer may leave reviews regarding transactions and products.

7.2. Reviews must be truthful and may not contain offensive, vulgar, false, or unlawful content.

7.3. The Administrator may remove reviews that violate the above rules.

8. Liability

8.1. The Platform is not liable for:

  • the quality, legality, or compliance with the description of listed products,
  • actions or omissions of Sellers and Buyers,
  • the consequences of concluding or not concluding transactions between Users.

8.2. The Administrator makes every effort to ensure the Platform operates correctly but does not guarantee uninterrupted availability or the absence of technical errors.

9. Personal Data and Privacy Policy

9.1. The administrator of Users’ personal data is DEVENUE Sp. z o.o.

9.2. Data is processed in accordance with applicable regulations (GDPR) and the Privacy Policy available on the website.

10. Final Provisions

10.1. The Terms of Service are available on the website: https://modelagora.com/regulamin

10.2. DEVENUE Sp. z o.o. reserves the right to amend the Terms of Service. Changes take effect upon publication on the website and notification of Users via electronic means.

10.3. In matters not regulated by these Terms of Service, the provisions of Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.
