1. Basic Information

1.1. This document sets out the rules for using the ModelAgora.com website (hereinafter: Service), operated by:

1.2. By using the Service, the User accepts these Terms of Use. If you do not accept them, please do not use the Service.

2. Scope of Services Provided

2.1. The ModelAgora.com Service provides functionalities enabling:

• browsing modeling product offers,
• registering a user account,
• publishing and selling products (for registered Sellers),
• communication between Users,
• logging in via Discord or using an e-mail account.

2.2. The Service acts as a mediating platform – it is not a party to transactions concluded between the Seller and the Buyer, except when DEVENUE Sp. z o.o. acts as the Seller itself.

3. Technical Requirements and Access

3.1. Using the Service requires:

• a device with Internet access,
• an up-to-date web browser,
• an active e-mail account (for registration/login).

3.2. The Administrator makes every effort to ensure the Service operates continuously and without errors, but does not guarantee full availability of services at all times.

4. Registration and User Account

4.1. Registration in the Service is voluntary and free of charge.

4.2. The User undertakes to provide true data and update it as necessary.

4.3. The User may not:

• create an account impersonating another person,
• use another person’s account without their consent,
• use the Service for unlawful activities.

4.4. The Administrator reserves the right to block or delete an account in case of violation of the Terms of Use or the law.

5. Copyright and User Content

5.1. The User retains copyright to the content they publish (e.g., product descriptions, photos), but grants the Service a non-exclusive, royalty-free license to use it for the functioning and promotion of the Service.

5.2. It is prohibited to publish content that is:

• unlawful,
• infringing the personal rights or copyrights of third parties,
• containing vulgarities, hate speech, pornography, calls for violence, or advertisements for competing services.

5.3. The Administrator may remove or hide content that violates the above rules without prior notice.

6. User Responsibilities and Liability

6.1. The User uses the Service at their own risk.

6.2. The User undertakes to:

• comply with the law and good practices,
• not send spam, malicious software, or phishing links,
• not provide misleading information (e.g., fake products, false contact details).

6.3. The User bears full responsibility for the content they publish and for actions taken through their account.

7. Administrator’s Liability Limitations

7.1. The Service Administrator is not liable for:

• the quality, legality, availability, or compliance with the description of products offered by external Sellers,
• the actions or omissions of Sellers and Buyers,
• any damage resulting from the use or inability to use the Service,
• technical interruptions or errors in the operation of the Service.

7.2. The Service may contain links to external websites. The Administrator is not responsible for the content published on these sites.

8. Reporting Violations and Complaints

8.1. The User may report violations, abuse, or irregularities to: kontakt@modelagora.com.

8.2. Complaints regarding the operation of the Service will be considered within 14 business days from the date of receipt.

9. Changes to the Terms of Use

9.1. The Administrator reserves the right to change these Terms of Use at any time, for valid reasons (e.g., changes in the law, changes in the Service’s functionalities).

9.2. The User will be informed of changes in advance, e.g., electronically or via a notice in the Service.

9.3. Use of the Service after the changes come into effect constitutes acceptance of those changes.

10. Final Provisions

10.1. In matters not regulated by these Terms, the relevant provisions of Polish law apply.

10.2. Disputes arising from the use of the Service will be resolved by the court with jurisdiction over the registered office of DEVENUE Sp. z o.o., unless mandatory provisions of law state otherwise.
